STANDARD TERMS AND CONDITIONS OF SALE

Fesha Toys

These Standard Terms and Conditions of Sale (“Terms”) govern all sales, transactions, and purchases made through Fesha App, Fesha Toys website, mobile application, warehouse, or any authorized sales channel. By placing an order, the customer agrees to these Terms.

1. Acceptance of Terms

  • By completing a purchase, the customer agrees to be legally bound by these Terms and Conditions.
  • Any terms and conditions provided by the customer shall not apply unless expressly agreed in writing by Fesha App.
  • Any exception or deviation from these Terms must be approved in writing by Fesha App.

2. Prices and Payments

  • All prices are displayed in Kuwaiti Dinars (KWD) and include applicable charges unless stated otherwise.
  • Fesha App accepts the following payment methods:
    • KNET
    • Credit Card
    • Apple Pay
    • Google Pay
    • Wallet credit (where applicable)
    • Cash on Delivery (if offered)
  • Payment must be completed at the time of purchase unless otherwise agreed.
  • Fesha App reserves the right to refuse or cancel any order if payment authorization fails or is declined.

3. Refunds and Payment Method Compliance

  • Refunds will be issued strictly to the original payment method used during purchase.
  • Customers may not request refunds through a different payment method.
    • Example: Card payments cannot be refunded in cash.
  • Refund timelines:
    • Cash refunds: up to 5 business days
    • KNET refunds: 5–7 business days
    • Credit Card / Apple Pay / Google Pay: 5–14 business days (depending on bank processing)
  • Alternatively, customers may choose:
    • Wallet credit
    • Promo code
    • Gift card
  • Delivery charges, gift wrapping fees, and shipping fees are non-refundable.

4. Returns and Exchanges

  • Returns are accepted within 14 days from the purchase date, subject to the Return & Exchange Policy.
  • Products must be:
    • Unused
    • Unopened
    • In original condition
    • In the original box
  • Products showing signs of use or damaged box are not eligible for return or refund.
  • Exchanges are permitted for:
    • Same value products
    • Higher value products (with payment of the difference)
    • Lower value products (difference provided as store credit)

5. Delivery and Ownership

  • Ownership of goods transfers to the customer upon full payment and delivery.
  • Delivery timelines are estimates and may vary due to operational or external factors.
  • Fesha App shall not be held liable for delays caused by courier services, customs, or force majeure.

6. Late Payment and Outstanding Amounts

  • If payment obligations exist (for corporate clients, invoices, or custom orders), invoices must be paid within the timeframe specified on the invoice.
  • In case of late payment:
    • Fesha App reserves the right to suspend services or deliveries.
    • A late payment fee of up to 10% of the outstanding amount may be applied.
  • If payment remains unpaid after 60 days, Fesha App reserves the right to:
    • Initiate debt recovery procedures
    • Refer the case to a debt collection agency
    • Recover all legal and administrative costs from the customer

7. Claims and Complaints

  • Any claims related to defective or incorrect products must be reported within 14 days of delivery.
  • Claims must include:
    • Order number
    • Proof of purchase
    • Description of issue
  • Fesha App reserves the right to inspect and verify all claims before approval.

8. Limitation of Liability

  • Fesha App shall not be liable for indirect, incidental, or consequential damages.
  • Fesha App's liability shall not exceed the value of the purchased product.
  • Fesha App is not responsible for misuse, improper handling, or unauthorized modifications of products.

9. Compliance with Kuwait Consumer Protection Law

  • These Terms and all sales transactions comply with the Consumer Protection Laws and Regulations of the State of Kuwait.
  • Customer rights are protected in accordance with applicable Kuwait law.

10. Governing Law and Jurisdiction

  • These Terms and Conditions are governed exclusively by the laws of the State of Kuwait.
  • Any disputes shall be subject to the exclusive jurisdiction of the courts of Kuwait.

11. Right to Modify Terms

  • Fesha App reserves the right to modify these Terms at any time without prior notice.
  • Updated Terms will be effective immediately upon publication on the website or application.
